Robert J. Dietz Recovers at Trial for Contractor Client on Overpayment to Subcontractor

Robert J. Dietz of BrigliaMcLaughlin recently obtained a judgment in favor of a contractor for overpayments made to an electrical and instrumentation subcontractor constructing a hexane-injection facility in Fairfax County, Virginia. In Utility Line Services, Inc. v. Contracting & Technical Services, Inc., Fairfax County Circuit Court, CL-2010-727, Mr. Dietz proved that the contractor had overpaid the electrical and instrumentation subcontractor for work ultimately performed by another subcontractor. In addition, Mr. Dietz established that the subcontractor’s counterclaim for change order work lacked sufficient support. Therefore, the Honorable Jane M. Roush found in favor of the contractor on its affirmative overpayment claim and denied the subcontractor’s counterclaim for change order work.
